Terms and Conditions
Photographic Materials and Copyright:
All photographic materials, such as original negatives, photos, or slides, shall be the exclusive property of the photographer. Insight Media Co. shall own the copyright in all images created and may use the work for samples, contests, exhibition, website, advertising and self-promotion. Usage outside the bounds of this agreement will require the Client’s consent.
Model agrees that, while he/she may use the Photos for purposes related to the promotion of Model’s modelling business, including, but not limited to: advertising, portfolios, composite cards, exhibitions, contests, and promotional web sites, Model will not sell or otherwise transfer publication rights to any of the Photos without Insight Media Co.’s prior consent.
Likewise, Insight Media Co. agrees that while we may use the Photos for purposes related to the promotion of Insight Media Co. photography business, including, but not limited to: advertising, portfolios, composite cards, exhibitions, contests, and promotional web sites, Insight Media Co. will not sell or otherwise transfer publication rights to any of the Photos except with Model’s prior consent.Insight Media Co. agrees that any use of the Model/Clients image shall be respectful and shall not portray the Model/Client in a negative, misleading, or defamatory light. The Model’s/Clients image will not be used in association with content that could reasonably be considered offensive, controversial, or damaging to the Model’s/Clients personal or professional reputation. Insight Media Co. shall consult with the Model/Client if there is any ambiguity around context or use that could impact public perception.
Client’s Usage:
The Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions thereof by parties other than the Photographer. If Client is obtaining a print for reproduction, Insight Media Co. authorizes Client to reproduce the print only as set forth under Special Usage Requirements. In such event, Client shall request that a copyright and credit notice for the Photographer be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.
Model agrees that the Photos shall not be cropped, altered or distorted in any way when they are used to promote Model’s modelling business. Any watermark and copyright notice that appear as part of a Photo must be left intact. If the client purchases the copyrights to the images within offered packages from Insight Media Co. the client may use the images for personal promotion and standard industry use (e.g., agency submissions, castings) without prior written consent.
Social Media:
This clause applies to all social media, including Facebook and blogs. When published online it is required that citation of Insight Media Co. be made. The client agrees that they will under no circumstances alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Facebook’s/Instagram’s Timeline), altered in color, or edited in any way.
Model understands that Insight Media Co. has the moral right to be identified as the author of the Photos when copies of the Photos are presented to the public, and shall communicate this understanding to publishers, designers and other third parties that act on Model’s behalf to create presentation material using the Photos.Insight Media Co. will post these photos on Instagram linking you as a collaborator for the post, by signing, you agree to this.When posting please tag @insightmediaco_ and write @insightmediaco_ in the caption section of the post.
