Welcome to Insight Media Co. (“we,” “us,” or “our”). By accessing or using our website, insightmediaco.com (the “Website”), and the services offered through the Website (the “Services”), you (being the person accessing or using our Website) agree to comply with and be bound by these Terms and Conditions (the “Terms”). These Terms govern the relationship between Insight Media Co., creative professionals (“Creatives”), and clients (“Clients”) who use our lead-finding platform.
Please read these Terms carefully before using the Website. If you do not agree to these Terms, you may not access or use our Services.
By accessing or using our Website, you agree to the entry into a contract in electronic form and content and to the use of electronic communications pursuant to the terms of the Electronic Transactions (Queensland) Act 2001.
1. Acceptance of Terms
By accessing the Website and using our Services, including registering as a Creative or a Client, you confirm that you have read, understood, and agree to these Terms. We reserve the right to modify or update these Terms at any time, and such changes will be effective upon posting. It is your responsibility to review the Terms regularly for any updates or changes.
A reference to Insight Media Co., a Creative or a Client, means and includes where the context allows, the party to this agreement together with the party’s principals, officers, employees, servants and agents.
2. Services Provided
Insight Media Co. provides a platform where:
- Creatives can promote their services and connect with potential Clients.
- Clients can search for and hire Creatives for creative services.
Our platform facilitates the connection between Creatives and Clients, but InsightMedia Co. is not a party to any agreement between Creatives and Clients. Therefore, Insight Media Co. is not liable for any actions by Creatives or outcomes ofservices by Creatives.
3. Membership Types
Free Membership
- Creatives can post up to 5 free service listings to showcase their offerings.
- Clients can browse Creatives at no up-front cost.
- No signup fees for Creatives or Clients.
- Access to key website pages such as Home, Services, Creatives, etc.
Insight Media Co. reserves the right to create a monthly paid membership option in the future that may change accessibility to select pages on the current free membership plan.
4. Fees and Commissions
For the use of our Services, the following commissions and fees apply:
For Creatives:
- 18% Commission: Insight Media Co. takes an 18% commission from the
total amount paid by Clients to Creatives for services booked through the
Website. - $5 Commission Fee: In addition to the percentage commission, a flat fee of
$5 is charged on each transaction.
For Clients:
- 0% Commission: Insight Media Co. takes a 0% commission from the total
amount paid by Clients for services booked through the Website. - $5 Commission Fee: A $5 flat fee applies to each transaction for Clients as
well.
All commissions and fees are deducted automatically from payments made throughthe Website. By using our Services, you acknowledge and agree to these fees.
5. Payment and Secure Transactions
- Holding of Funds: For all transactions, Insight Media Co. holds the payment in escrow until the service is marked as completed by the Client and Creative.
- Release of Funds: Once the Client confirms that the service has been completed satisfactorily, funds (minus applicable commissions and fees) will be released into the Creative’s account.
- Disputes: If a Client or Creative disputes the completion or quality of the service, Insight Media Co. will withhold payment to the recipient until the dispute is resolved (see Section 7 for Dispute Resolution).
6. Booking and Cancellations
Booking Process:
- Clients can browse Creatives and book their services by selecting a date and time and providing a description of the task.
- All bookings must be made at least 7 days before the intended service date. If made within the 7-day window, the Creative may not be available and may decline the booking.
Cancellation Policy:
Cancelled by the Client:
- Cancellations 7 Days or More Before the Service Date: Full refund.
- Cancellations Under 7 Days Before the Service Date: 50% refund.
- Day-of-Service Cancellations: No refund.

7. Professionalism and Conduct
All users (Clients and Creatives) are expected to behave in a professional and respectful manner. Insight Media Co. is not responsible for the conduct of users but we reserve the right in our absolute discretion to suspend or terminate accounts for inappropriate behaviour.
8. Dispute Resolution
If a dispute arises regarding a service or payment, Insight Media Co. offers the following process:
- Both the Client and Creative are required to provide evidence supporting their case.
- Insight Media Co. will review the dispute and may mediate between both parties to reach a resolution.
- Insight Media Co. reserves the right to make the final decision on any dispute and determine whether a partial or full refund, or payment to the Creative, is appropriate.
9. Use of the Website
By using the Website, you agree not to:
- Engage in fraudulent or illegal activity, misrepresentation, or abusive behavior toward other users.
- Use the Website for any illegal or unauthorized purpose.
- Interfere with or disrupt the Website’s functionality.
Insight Media Co. reserves the right to suspend or terminate any account that violates these Terms or engages in activities deemed harmful to the platform or its users.
10. Content and Intellectual Property
All content on the Website, including logos, text, graphics, and images, is the property of Insight Media Co. or its licensors. You may not reproduce, distribute, or use this content without our express written permission.
As a Creative, any content you upload, including service descriptions, profiles, and media, must not infringe on the intellectual property rights of others. By submitting content to the Website, you grant Insight Media Co. the right to display, distribute, and promote your content as part of our Services.
11. Limitation of Liability
Insight Media Co. is a platform that facilitates connections between Clients and Creatives. Users acknowledge that we do not act as an agent or representative of any Client or Creative.
We are not responsible or liable for:
- The quality or outcome of services provided by Creatives.
- The conduct or actions of Clients or Creatives.
- Any disputes, damages, or losses that arise from interactions or transactions between users.
Users engage in interactions and transactions based on their own assessment of the proposed service and the acceptance of any risks associated with it. Insight Media Co. is not liable for any illness, injury or death or loss or damage to property however arising out of or incidental to the provision of any Service or for any indirect, incidental, or consequential damages arising from your use of the Website or our Services or from any interaction or transaction between users.
Each Client and Creative agrees to indemnify and keep Insight Media Co.indemnified in respect to any claim, demand, suit or action against it in respect of any illness, injury or death or loss or damage to property however arising out of or incidental to the provision of any Service or for any indirect, incidental, or consequential damages arising from the use of the Website or our Services or from any interaction or transaction between users.
12. Termination
Insight Media Co. reserves the right to terminate or suspend your account and access to the Website at our sole discretion, without notice, for conduct that violatesor which, in our reasonable opinion, violates these Terms or is otherwise deemed harmful to the platform or other users.
13. Privacy Policy
Our Privacy Policy governs the collection, use, and protection of your personal data when using our Website. Please refer to our Privacy Policy for more information.
14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Queensland. Any disputes arising under these Terms and Conditions shall be resolved exclusively in the courts of Queensland.
